Polka mailbox policy

By using or accessing the polka mail service, you agree to be bound by the rules which follow below, as well as the applicable policies which appear under Legal Notices (our "Terms and Conditions").

1. All polka subscribers will as of 17 April 2007 have access to a 100 Mb mail box (your "primary mailbox"), as part of the standard subscription fee of R75.00 (seventy five Rand).
    
2. You may upgrade the size of your mailbox at any time to a maximum of 200 Mb, in increments of 50 Mb and at a cost of R13.00 (thirteen Rand) per 50 Mb per month, subject to the following:
   1. you have to notify polka to make the necessary arrangements;
   2. you may not be in default of payment of the standard subscription fee;
   3. you will pay us the cost of the increment for the first month at the beginning of that month (should you notify us that you require the increment before the end of the previous month) or the pro rated portion of the cost of the increment for the first month (for example, should you upgrade with 50 Mb in the middle of the month, we will charge you R6.50, which will appear on your statement at the end of that month);
   4. after the first month you will pay us the cost of the increment monthly in advance; and
   5. you may downgrade on the size of your mailbox at any time, but have to do so prior to the date on which your debit order goes off, failing which you will be billed for the next calendar month.
    
3. You can also buy 1 (one) additional 100 Mb mail box from us (your "secondary mailbox"), at a cost of R18.00 (eighteen Rand) per month, which will be linked to your account, subject to the following:
   1. you acknowledge that the secondary mailbox has the protocol to send and retrieve mail and to send and receive fax, but not to access the Internet;
   2. you have to notify polka to make the necessary arrangements;
   3. we will activate your secondary mail box within 1(one) hour of your request;
   4. you will pay us the cost of the secondary mail box for the first month at the beginning of that month (should you notify us that you require the secondary mail box before the end of the previous month) or the pro rated portion of the cost for the first month (for example, should you request a secondary mail box in the middle of the month, we will charge you R9.00, which will appear on your statement at the end of that month);
   5. after the first month you will pay us the charge for the secondary mail box on a monthly basis in advance; and
   6. you can terminate your secondary mailbox by giving us 1 (one) calendar months’ written notice.
    
4. In order to keep our mail servers efficient, we need to apply the following restrictions to your mailbox:
   1. time limit: Polka will delete any mail that is older than 90 (ninety) days, or which has not been retrieved within 90 (ninety) days;
   2. if you exceed your mailbox size, no new mail or attachments will be delivered to your mailbox. You will, however, be able to receive mail again if you either delete mail and/or attachments from your mailbox or by purchasing additional space;
   3. subject to any other technical limitations, polka restricts the size of an individual mail, sent or received, to 10Mb per mail; and
   4. the number of recipients on your mailing list may not exceed 50.
    
5. Polka reserves the right to reclaim your mail address during the course of your subscription should polka, in its sole discretion, deem this necessary.
    
6. Polka shall be entitled to take such steps to fight spam / junk-mail / unsolicited mail / viruses as polka may deem necessary and/or appropriate from time to time, including (without being limited to) not delivering any mail which polka, in its sole discretion, suspects of being or containing spam / junk-mail / unsolicited mail / viruses.
    
7. Polka reserves the right to reduce the size of your mailbox, should you be in breach of the Terms and Conditions under which this service is provided to you.
    
8. Upon cancellation of your subscription you will lose and polka will re-claim your username and mail address. Polka may re-issue your username and mail address to a new subscriber 90 days after termination of your polka subscription. It is your responsibility to inform everyone so that they do not inadvertently send mail intended for you to the new subscriber.
    
9. You agree that polka shall not be liable to you or any third party in respect of any loss or damage howsoever caused by or arising from the implementation by polka of the mailbox rules, as set out above. This exclusion of liability of polka for loss or damage will include (but is not necessarily limited to):
   1. loss or damage caused by negligent acts of polka and any acts of polka’s employees;
   2. any direct, consequential, incidental, indirect or special loss or damage flowing from business interruption, loss of business information, loss of data or any other cause;
   3. any loss or damage, regardless of whether a claim for such loss or damage is based on breach of contract, delict, breach of implied warranties or otherwise; and
   4. any loss or damage, whether it could have been foreseen or not.
    
10. Polka reserves the right to change the above rules at any time.
    1. We reserve the right to amend this agreement from time to time without notice to you. Any new version of the agreement will be displayed on our web site together with the date on which it will become effective, which will never be less than 30 days after the date on which it is first displayed. It is your obligation to visit our web site on a regular basis in order to ascertain whether any amendments have been made.
     
11. You acknowledge and agree that by using and accessing the polka mail service you will become bound to the then current version of these rules (the "current version") and, unless stated otherwise in the current version, all previous versions will be superseded by the current version.
     
12. You will be responsible for reviewing the then current version each time you use the polka mail service.
     
13. Without derogating from the aforegoing, and without imposing any obligation on polka whatsoever, polka reserves the right to give you notification of amendments of the these rules either by email or by posting a notice on the polka portal. On notification of the existence of the amended rules, you will be obliged to visit the legal section of the polka portal and view the then current version.
     
14. A certificate signed by polka (or by one of polka 's directors, whose appointment, qualification and authority need not be proved) will be prima facie proof of the date of publication and content of the current version and all previous versions of the rules.
     
15. Polka reserves the right to terminate its offering of any specific mailbox size by giving you reasonable notice.
